Relocation with children
It sometimes becomes necessary for one parent to relocate to a new geographic location. If the relocating parent wishes to relocate with the children, and the relocation will result in a substantial change in the geographic relationship between the children and the non-relocating parent, such as would normally occur with an out-of-state move, the non-relocating parent may object to the relocation. Whether you are the relocating parent or the non-relocating parent, we will represent you to ensure that your relationship with your children is protected.
Premarital and marital agreements
Spouses, future spouses and civil union partners often wish to formally define or modify their respective rights and obligations if the relationship ends in dissolution or one of the parties dies. If you or your spouse, future spouse or civil union partner wish to formally define or modify the scope of your rights and obligations in the event of dissolution or death, or if an agreement has already been made and one of you is now seeking to enforce the agreement, we’ll represent you to ensure your rights are protected and your goals are met.
Same sex divorce/ civil unions
If you are a spouse in a same sex marriage and wish to commence divorce or separation proceedings, or if you have been served with divorce papers, we will represent you in the divorce or separation proceedings. We will handle the entire case from start to finish, or, if you desire, we will handle one or more distinct aspects of your case or advise you from the sidelines while you handle the bulk of the work.
Colorado still recognizes civil unions and grants parties to a civil union the same rights, benefits and responsibilities as married persons. However, there are some important distinctions between a marriage and a civil union. If you are contemplating entering into a civil union or are already a party to a civil union and have questions regarding your rights and responsibilities, we’ll represent you to ensure your rights are protected and your goals are met.
Colorado law allows for grandparent visitation rights in certain circumstances, even if the parents object to grandparent visitation. If you are a grandparent who is being denied visitation with your grandchild, or if your child’s grandparent is seeking visitation with your child over your objection, we’ll represent you to ensure your rights are protected and your goals are met.
If you or another person wish to establish the paternity of a child, or if another person is attempting to establish your paternity of a child over your objection, we’ll represent you in the paternity action.
Child Dependency and Neglect Proceedings
If you are involved in a Dependency and Neglect (D&N) proceeding based on suspected child abuse or neglect, or are an extended family member or foster parent who wishes to intervene in a D&N proceeding to protect a child, we’ll represent you to ensure your goals are met and the child remains safe.
If you wish to adopt a child or object to another person adopting your child, we’ll guide you through the legal process.
If your ex-spouse or child’s other parent has violated a court order regarding property transfer, maintenance, parenting time, child support, or any other issue, he or she may be in contempt of court. If you wish to institute contempt proceedings against your ex-spouse or child’s other parent, or if you have been served with a contempt citation, we’ll represent you to ensure your rights are protected and your goals are met.
Substance abuse and parenting
If your child’s other parent abuses drugs or alcohol and you are concerned about his or her ability to supervise and care for your child, or if you have been accused of substance abuse and your child’s other parent is attempting to restrict your parenting rights, we’ll represent you to ensure that your child is safe and your parenting rights are protected.
Domestic abuse and civil protection orders
If you or your child have been the victim of actual or threatened domestic violence, we’ll immediately institute proceedings to obtain a temporary civil protection order (CPO) and an award of temporary care and control of your child to help protect you and your child until the hearing for a permanent CPO.
We’ll prepare and file all court documents, and present your case to the judge at the permanent CPO hearing to ensure that you and your children are physically and emotionally safe and protected.
If you receive an adverse ruling from the court on any issue, you may have the right to appeal to the Colorado Court of Appeals and, in some cases, to the Colorado Supreme Court, to overturn the adverse ruling. Whether you are the appealing party or appellee, we will represent you at the Court of Appeals and Supreme Court to ensure your rights are protected and your goals are met.
